10 recent hospital lawsuits, settlements 

From a New York hospital suing its fired CEO to a judge ordering Steward Health Care to pay nearly $1 billion in a malpractice case, here are 10 hospital lawsuits, settlements and legal developments that Becker’s has reported since Aug. 13: 

1. The Justice Department filed a civil complaint against Toledo, Ohio-based ProMedica Health System for providing “nonexistent, grossly substandard skilled nursing facility care or services” between 2017 and 2023.

2. Utah Third District Court Judge Patrick Corum ordered Dallas-based Steward Health Care to pay $951 million to a family after finding the health system liable for medical malpractice for birth injuries sustained during the 2019 delivery of a child at its former West Valley City, Utah-based Jordan Valley Medical Center. 

3. Las Cruces, N.M.-based Mountain View Regional Medical Center settled a class-action lawsuit that accused the hospital of illegally suing hundreds of patients over unpaid medical bills. 

4. A former Emory Healthcare finance department employee filed a class-action lawsuit alleging the Atlanta-based system violated the federal WARN Act by laying off workers without the required 60 days’ notice.

5. Chris Pernell, MD, former chief strategic integration and health equity officer at University Hospital in Newark, N.J., is suing the hospital, alleging she was illegally forced out in 2022. 

6. Providence hospitals across California are the latest to sue Kaiser Permanente over allegations that the organization’s health plan has underpaid for emergency and post-stabilization care provided to Kaiser Health Plan members.

7. Nassau University Medical Center in East Meadow, N.Y., filed a lawsuit against Megan Ryan, the president and CEO it terminated in June. The hospital’s parent company, Nassau Health Care Corp., is seeking at least $10 million in punitive damages for counts including breach of contract and breach of fiduciary duty. 

8. Asheville, N.C.-based Mission Health and its owner, Nashville, Tenn.-based HCA Healthcare, settled a lawsuit filed by several North Carolina counties and municipalities alleging anticompetitive practices. 

9. Rockford, Ill.-based Mercyhealth will pay more than $1 million to settle U.S. Equal Employment Opportunity Commission charges that alleged religious discrimination related to the COVID-19 vaccine mandate. 

10. An oversight committee representing the bankrupt Mercy Iowa City hospital filed a complaint seeking to recover at least $55 million from MercyOne, Iowa Heart Center and a former hospital CEO.
